General Terms and Conditions (GTC)

hereinafter referred to as the Gusskönig.

1. Scope

The following terms and conditions apply to all orders submitted electronically, by telephone, fax, letter or e-mail to Gusskönig by consumers within the meaning of §13 BGB (hereinafter referred to as "customer") and are accepted by the customer with each order.

Any differing, conflicting, or supplementary terms and conditions shall not become part of the contract unless their validity is expressly agreed to in writing. Any standard (or individually agreed) reference to the customer's terms and conditions is expressly rejected.

2. Conclusion of the contract

The presentation of Gusskönig's product range on the internet does not constitute an offer within the meaning of Sections 145 et seq. of the German Civil Code (BGB). By placing an order, the customer submits a binding offer to purchase from Gusskönig. Gusskönig is entitled to accept the order by delivering the goods or by notifying Gusskönig of shipment via an order confirmation email within 7 days of receiving the order. Acceptance is subject to the availability of the goods, in particular to the correct and timely delivery to Gusskönig by its suppliers.

This only applies if the non-delivery is not Gusskönig's fault. Should the goods be unavailable, Gusskönig will inform the customer immediately and promptly refund any payments already made. An order confirmation email, automatically generated and sent by the system immediately after the customer's order is received, does not constitute a binding acceptance of the offer by Gusskönig. During the ordering process, the risk of any transmission errors that cannot be resolved lies with the customer. Gusskönig sells its goods only in standard commercial quantities.

3rd Prizes

The prices listed online at the time of ordering apply. The prices shown are final prices, meaning they include the applicable statutory value-added tax and all other price components. We reserve the right to make reasonable technical changes as well as changes in form, color, and/or weight.

4th delivery

Subject to availability, Gusskönig will deliver ordered goods to the customer as quickly as possible. If not all ordered goods are in stock, Gusskönig reserves the right to make partial deliveries. Gusskönig will bear the costs of any partial deliveries.

5. Cancellation Policy

You have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period will expire after 30 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You may use the model withdrawal form, but this is not obligatory. You can also electronically fill in and submit the model withdrawal form or another clear statement on our website (www.gusskoenig.de). If you make use of this option, we will immediately send you confirmation of receipt of such a withdrawal (e.g. by email). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of the revocation:

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our standard, cost-effective option), without undue delay and no later than 30 days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to us without undue delay and in any event no later than 30 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 30 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

6. Payment

Customers can choose from Klarna invoice, PayPal, or credit card (MasterCard/Visa) as payment options. The purchase price is due upon receipt of the goods and must be paid in full, without any deductions, within 14 days of receipt.

7. Retention of title

All delivered goods remain the property of Gusskönig until full payment has been received. This retention of title also extends to processed goods and, in the case of resale, to the purchase price claim (extended retention of title).

8. Warranty

The warranty is governed by statutory regulations. Should a manufacturer grant a longer product warranty, the customer can, of course, assert their legitimate claims under this warranty against the manufacturer even after the seller's warranty has expired.

The customer's warranty claims are initially limited to the right to repair or replacement. If repair or replacement fails, the customer is entitled to a reduction in price or to withdraw from the contract. Repair is considered unsuccessful after the second failed attempt, unless the nature of the item or the defect, or other circumstances, indicate otherwise. In cases of incorrect operation or improper use of the goods, the customer bears the costs of any technical inspection of the goods initiated by them or any repair or replacement carried out at their request.

9. Limitation of Liability

Despite exercising the utmost care in compiling its product range, Gusskönig cannot assume liability for the accuracy of manufacturer specifications, product descriptions, and prices, nor for any printing errors, technical modifications, or the continued availability of all goods. Gusskönig excludes liability for damages caused by simple negligence, unless such damages relate to essential contractual obligations, damages resulting from injury to life, body, or health, or breaches of guarantees, or unless claims under the Product Liability Act are affected. The same applies to breaches of duty by Gusskönig's agents.

10. Data protection

The data necessary for processing your order will be stored and, if necessary, shared with affiliated companies as part of order fulfillment. This notice is provided in accordance with the provisions of Section 33 Paragraph 1 of the German Federal Data Protection Act (BDSG). All personal data will, of course, be treated confidentially. By placing an order, the customer consents to the storage of their data. They are entitled to view their data at any time and, if necessary, have it modified or deleted. For requests to modify or delete their data, customers can contact Gusskönig at support@gusskoenig.de.

11. Jurisdiction, applicable law, arbitration, invalidity rules

This contract is governed exclusively by the laws of the Federal Republic of Germany. The place of jurisdiction is Magdeburg. Gusskönig is neither legally nor voluntarily obligated to participate in dispute resolution proceedings before a consumer arbitration board under the Act on Alternative Dispute Resolution in Consumer Matters (Consumer Dispute Resolution Act - VSBG). Gusskönig also declares that it is neither willing nor willing to participate in such proceedings if the customer requests, wishes to have, or otherwise initiates such proceedings.

Should individual provisions of the contract with the customer, including these General Terms and Conditions, be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected.

The wholly or partially ineffective regulation should be replaced by a regulation whose economic success comes as close as possible to that of the ineffective one.
